These Terms of Use ("Terms") govern access to and use of CircuitDigest Cloud ("Platform", "Service", "we", "our", or "us"), operated by Semicon Media Private Limited.

CircuitDigest Cloud is part of the CircuitDigest ecosystem of platforms and services focused on embedded systems, electronics, IoT, automation, and related software technologies.

By accessing, registering for, or using CircuitDigest Cloud, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must discontinue use of the platform.

1. Description of Service

CircuitDigest Cloud is an IoT and embedded systems cloud platform intended to help developers, engineers, makers, students, businesses, and technology enthusiasts prototype, deploy, manage, monitor, automate, and integrate internet-connected devices and software systems.

Platform functionality may include MQTT communication, APIs, telemetry storage, dashboards, remote device management, automation systems, notifications, integrations, collaboration tools, file uploads, device sharing, workspace management, and future platform capabilities introduced from time to time.

The platform may communicate with hardware devices including microcontrollers, System-on-Modules (SoM), Single Board Computers (SBC), embedded devices, IoT products, and related systems.

2. Eligibility and Account Registration

Users may be required to create an account to access certain platform features.

Users are responsible for maintaining accurate account information and for safeguarding login credentials, authentication tokens, API keys, device credentials, and account access.

Users are fully responsible for all activities occurring under their accounts, devices, workspaces, or integrations.

3. Acceptable Use

Users agree not to use CircuitDigest Cloud for unlawful, harmful, abusive, or unauthorized purposes.

Prohibited activities include, but are not limited to:

• Unauthorized access to systems, accounts, devices, or networks
• Distribution of malware, spam, phishing content, or malicious software
• Interference with platform stability, infrastructure, APIs, or network operations
• Use of the platform for illegal surveillance or unlawful data collection
• Attempts to bypass authentication, rate limits, or security protections
• Abusive automation or excessive resource consumption
• Violation of applicable laws, regulations, or third-party rights

We reserve the right to suspend, restrict, or terminate access to the platform at our sole discretion where misuse, abuse, unlawful activity, or platform disruption is detected or suspected.

4. Device Responsibility and User Obligations

Users are solely responsible for the design, deployment, operation, monitoring, maintenance, and security of their connected hardware devices, firmware, APIs, automation systems, electrical systems, networking infrastructure, and software configurations.

Users are responsible for implementing appropriate supervision, manual overrides, safety controls, redundancies, and fail-safe mechanisms for all connected systems and automation workflows.

CircuitDigest Cloud does not manufacture, certify, inspect, validate, or guarantee the safety, reliability, compatibility, or operational behavior of third-party hardware devices or user-developed systems connected to the platform.

Users acknowledge that improper hardware configuration, firmware defects, automation failures, network interruptions, delayed commands, software bugs, electrical faults, or integration failures may result in unexpected behavior, data loss, service interruption, equipment damage, or physical harm.

5. Restricted and High-Risk Usage

CircuitDigest Cloud is not designed, certified, or intended for use in mission-critical or high-risk environments.

The platform must not be used in connection with:

• Life-support systems
• Medical devices or medical monitoring systems
• Emergency response systems
• Industrial safety systems
• Hazardous environment controls
• Critical infrastructure systems
• Applications where system failure could result in injury, death, property damage, or environmental harm

Users assume full responsibility and risk for any deployment of the platform in automation or control systems.

6. Platform Availability and Infrastructure

CircuitDigest Cloud relies on internet connectivity, cloud infrastructure, APIs, integrations, and communication systems that may occasionally experience interruptions, delays, outages, synchronization issues, maintenance events, or unexpected behavior.

We do not guarantee uninterrupted availability, real-time execution, guaranteed message delivery, or error-free operation of the platform.

Users are responsible for validating automation behavior, connected device actions, and deployment safety before relying on the platform in real-world environments.

7. User Content and Data

Users retain ownership of data, telemetry, files, dashboards, automation logic, device configurations, and other content uploaded or transmitted through CircuitDigest Cloud.

By using the platform, users grant CircuitDigest Cloud a limited right to process, store, transmit, analyze, display, and manage such content solely for the purpose of operating and improving the platform and related services.

Users must not upload or transmit unlawful, harmful, confidential, regulated, or sensitive information through the platform unless they independently implement appropriate security safeguards and comply with applicable laws.

8. Sharing, Collaboration, and Access Control

The platform may support workspace collaboration, dashboard sharing, device sharing, API access, integrations, and related multi-user functionality.

Users are solely responsible for configuring permissions, access controls, visibility settings, API exposure, and sharing configurations associated with their resources.

CircuitDigest Cloud is not responsible for unauthorized access, misuse, exposure, or modification of resources resulting from user-configured permissions or third-party access.

9. Integrations and Third-Party Services

CircuitDigest Cloud may support integrations with third-party platforms, APIs, automation systems, communication services, AI-powered services, analytics providers, payment processors, and related external systems.

Third-party services operate independently and may be subject to their own terms, policies, technical limitations, availability conditions, and operational requirements.

We are not responsible for interruptions, service failures, compatibility issues, or operational behavior associated with third-party services or integrations.

10. Notifications and Communications

Users are solely responsible for the legality, accuracy, authorization, timing, and content of notifications, alerts, emails, SMS messages, messaging platform communications, webhooks, or automated communications initiated through the platform.

11. Payments and Future Commercial Services

CircuitDigest Cloud is currently provided free of charge, subject to platform limits, fair usage policies, and rate limiting intended to maintain system stability and prevent abuse.

We reserve the right to introduce paid services, subscriptions, usage tiers, commercial features, APIs, integrations, or enterprise offerings in the future.

Payment transactions, where applicable, may be processed by authorized third-party payment processors.

12. Intellectual Property

CircuitDigest Cloud, including its software, infrastructure, branding, design, APIs, documentation, platform architecture, and related materials, are owned by or licensed to Semicon Media Private Limited unless otherwise stated.

Users may not copy, reproduce, distribute, reverse engineer, modify, resell, sublicense, or commercially exploit platform components except as expressly permitted by applicable law or written authorization.

13. Disclaimer of Warranties

CircuitDigest Cloud is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise.

To the maximum extent permitted by law, we disclaim all warranties including, but not limited to:

• Availability or uninterrupted operation
• Accuracy or reliability of telemetry or automation
• Fitness for a particular purpose
• Compatibility with hardware or third-party systems
• Security or error-free operation
• Guaranteed message delivery or synchronization

14. Limitation of Liability

To the fullest extent permitted by applicable law, Semicon Media Private Limited, CircuitDigest Cloud, its affiliates, directors, employees, contractors, partners, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

• Use or inability to use the platform
• Automation failures or delayed commands
• Device malfunction or hardware damage
• Electrical failures or unsafe deployments
• Loss of telemetry, files, or data
• Third-party service interruptions
• Network outages or communication failures
• Unauthorized access or security incidents
• User-developed firmware, APIs, or integrations

Users acknowledge and accept that the platform is intended for development, prototyping, experimentation, learning, automation, and general-purpose IoT applications and should be deployed responsibly with appropriate safeguards.

15. Suspension and Termination

We reserve the right to suspend, restrict, limit, or terminate user accounts, API access, integrations, devices, workspaces, or platform usage at our discretion where necessary to:

• Protect platform integrity or security
• Prevent abuse or unlawful activity
• Maintain service reliability
• Enforce these Terms
• Comply with legal obligations

Users may discontinue use of the platform and delete their accounts through platform settings where supported.

16. Modifications to the Platform and Terms

We may modify, suspend, discontinue, improve, or update any aspect of CircuitDigest Cloud at any time without prior notice.

We may also update these Terms periodically. Continued use of the platform after updated Terms are published constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising in connection with these Terms or the use of CircuitDigest Cloud shall be subject to the jurisdiction of the courts located in India.
